What this site is, what it isn't, and the rules that come with using it. Plain terms, no hedging.
These Terms of Use govern your use of betterdivorceaustin.com (the “Website”), operated by Trusler Legal PLLC, a professional limited liability company formed in Texas (“the firm,” “we,” “us,” “our”). Better Divorce Austin is the firm’s consumer-facing brand; Trusler Legal PLLC is the law firm behind it.
By using the Website you agree to these terms. If you do not agree, please do not use the Website. How the firm handles information collected through the Website is covered separately in our Privacy Policy, which is part of these terms.
This is attorney advertising.
The Website is a communication about legal services. It has not been approved by the Supreme Court of Texas or the Texas Board of Legal Specialization. Cristi Trusler is responsible for the content of this Website. Unless a specific certification is stated, no lawyer at the firm is certified by the Texas Board of Legal Specialization in any area of practice.
Any description of past results does not guarantee a similar outcome. Every family law matter turns on its own facts, its own county, and often its own judge.
Using this site does not make you a client.
Nothing on the Website is legal advice, and reading it does not create an attorney-client relationship. Neither does sending us an email, filling in a form, booking a consultation, or sending a text message. An attorney-client relationship with Trusler Legal PLLC begins only when the firm and the client sign a written representation agreement.
Until that agreement is signed, do not send us confidential or time-sensitive information. Information you send before an engagement exists may not be treated as confidential, and the firm may already represent someone whose interests conflict with yours.
Nothing on the Website is a solicitation to represent you in a state where the firm is not licensed. The firm practices Texas family law.
Deadlines are real, and this site will not catch them.
Family law matters carry deadlines that can end a right permanently if missed. The Website is general information published at a point in time; the law changes, and local rules differ by county and by court. Do not rely on anything here in place of advice from a lawyer about your own situation. If something is time-sensitive, call the firm at (512) 481-0330. Do not use the Website, email, or text messages to report an emergency.
Text messaging (SMS) program.
Program name: Trusler Legal PLLC (Better Divorce Austin).
What we send. The firm operates a text messaging program with two audiences, and no others:
- Firm staff — employees of the firm text an internal assistant to request administrative tasks, and receive the result or an explicit failure in reply.
- Clients of the firm — appointment reminders, case updates, document requests, and replies to messages the client sends us, about that client’s own legal matter.
The firm does not send marketing, promotional, or advertising text messages, and does not text anyone who is not a firm employee or a client who has signed the firm’s representation agreement.
How you opt in. Clients consent in writing by signing the firm’s representation agreement, which states that by providing a mobile phone number the client consents to receive text messages from the firm about their legal matter. The signed agreement is kept in the client’s file and is the firm’s record of consent. Firm staff are given the internal number as part of their job. There is no way to opt in through this Website, and consenting to text messages is never a condition of hiring the firm or of receiving any legal service.
Message frequency. Message frequency varies with activity in your matter. There is no recurring schedule and no minimum number of messages.
Cost. Message and data rates may apply. The firm does not charge you for text messages; your mobile carrier may.
How to stop. Reply STOP to any text message from the firm to opt out at any time. You will receive one confirmation message and then no further texts. Reply HELP to any message for assistance, or contact us at (512) 481-0330 or hello@betterdivorceaustin.com. Opting out of text messages does not affect your representation, your fees, or your ability to reach the firm by phone or email.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Text messages are not secure and not confidential in the way a phone call is. They are retained by your carrier and stored on your device, where someone else may see them. Do not use text messaging for substantive or sensitive case communications, and do not use it for anything urgent.
Mobile phone numbers, SMS opt-in data, and messaging consent are handled as described in our Privacy Policy, and are not sold, rented, leased, or shared with any third parties or affiliates for marketing, promotional, or lead-generation purposes.
What you may do with this site.
You may read, print, and share the Website’s pages for your own personal, non-commercial use, keeping any attribution intact. You may link to it.
You may not:
- republish, sell, or license the Website’s content, or present it as your own;
- use it to train a machine learning model or to build a competing service;
- scrape, crawl, or harvest the Website beyond ordinary search-engine indexing;
- attempt to gain unauthorized access to the Website or any related system;
- use the Website to send unsolicited commercial messages, or to collect contact information for that purpose;
- interfere with the Website’s operation or its availability to others.
Who owns what.
The Website’s text, design, photographs, logos, and downloadable materials are owned by the firm or used under licence, and are protected by copyright and trademark law. “Better Divorce Austin” and “Trusler Legal” are marks of the firm. Nothing in these terms grants you a licence to use them.
If you believe material on the Website infringes your copyright, write to hello@betterdivorceaustin.com with enough detail to identify the work and the page, and we will look into it.
Downloads, calculators, and tools.
Any workbook, checklist, calculator, or other tool on the Website is general educational material. A calculator returns an estimate from the numbers you enter using general Texas guidelines; it does not account for the facts a court would consider, and it is not a prediction of what any court will order. Do not make a decision about your case based on a number this site produced.
Other websites.
The Website links to resources the firm does not control — courts, government agencies, and third-party services. Those links are provided for convenience. The firm does not endorse and is not responsible for their content, their accuracy, or how they handle your information. When you follow a link away from the Website, the destination’s own terms and privacy policy govern.
Scheduling on the Website is handled by an embedded third-party service. Information you enter into it is received by that provider under its own terms, as described in our Privacy Policy.
The site is provided as it is.
The firm works to keep the Website accurate and available, but provides it “as is” and “as available.” To the fullest extent Texas law allows, the firm disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components.
To the fullest extent Texas law allows, the firm is not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Website, or for any decision you make in reliance on it.
Nothing in these terms limits the firm’s responsibility to its own clients for the legal services it provides. A client’s rights are governed by the signed representation agreement and by the Texas Disciplinary Rules of Professional Conduct, and nothing here waives, limits, or replaces them. Nothing in these terms limits any liability that cannot be limited under Texas law.
Accessibility and feedback.
The firm works to keep the Website usable by everyone; see our Accessibility Statement. If something on the site is hard to use or unreadable, tell us at hello@betterdivorceaustin.com and we will fix it or get you the information another way.
If you send us a suggestion about the Website, the firm may use it without owing you anything. Please do not send confidential information as feedback.
Governing law and where disputes go.
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute about the Website or these terms will be brought in the state or federal courts located in Travis County, Texas, and you agree to that venue.
If you are a client of the firm, the dispute-resolution provisions of your signed representation agreement control over this section for anything relating to the representation.
Nothing in these terms limits your right to file a grievance with the State Bar of Texas or to report professional misconduct to any disciplinary authority.
The rest of the fine print.
If any part of these terms is found unenforceable, the rest stays in force. The firm not enforcing a term on one occasion does not waive it. These terms, together with the Privacy Policy, are the entire agreement between you and the firm about your use of the Website.
The firm may update these terms. The date at the top of this page shows when it last changed. Continuing to use the Website after a change means you accept the updated terms. If a change materially affects the text messaging program described above, the firm will say so in the program description rather than change it quietly.
